Terms of service

These terms are an agreement between Triple Layer (“we”), which operates the ShopMail app, and the Shopify merchant who installs it (“you”). By installing or using ShopMail you accept them. If you do not accept them, uninstall the app.
The service
ShopMail sends marketing campaigns and automatic emails, such as abandoned checkout reminders and order follow ups, to your store’s customers on your behalf, and shows you how they perform. Emails go out from our shared sending domain under your store’s name, with replies going to your store’s contact email.
Your responsibilities
- You only email people you are allowed to email. ShopMail sends marketing only to customers whose Shopify email marketing consent is subscribed, and you must not work around that.
- You do not upload or email purchased, rented or scraped lists.
- Your emails are truthful and lawful, and you follow the email and privacy laws that apply to your store, such as CAN-SPAM, GDPR and CASL.
- Your store’s address in Shopify is accurate, because the law requires it in every marketing email.
- You do not use ShopMail for spam, phishing, malware, or content that is illegal, deceptive or harassing.
Protecting deliverability
Every store shares our sending reputation, so we protect it for everyone. New stores start with a daily sending limit that grows over time. If your emails bounce or are reported as spam more than mailbox providers allow, marketing emails pause automatically and we tell you why in the app. Order emails keep going. We may also pause or end marketing for a store that breaks these terms.
Plans and billing
- Plans, prices and monthly email allowances are shown in the app and on our App Store listing.
- Paid plans are billed by Shopify on your Shopify invoice, and Shopify’s billing terms apply to those charges.
- When a month’s allowance is used, marketing emails stop until the next month or until you upgrade.
- You can change or cancel your plan at any time. Uninstalling the app cancels it.
Your data
Your store data and your customers’ data stay yours. We use them only to run ShopMail for you, as described in our privacy policy. When you uninstall, Shopify asks us to erase your store’s data and we do.
Availability and changes
We work to keep ShopMail running and your emails delivered, but we cannot promise it will never be interrupted, or that any email reaches an inbox, because mailbox providers decide that. We may improve or change features. If we change these terms in a way that matters, we will tell you in the app before it takes effect.
Liability
ShopMail is provided as is. To the extent the law allows, we are not liable for indirect or lost profits, and our total liability for any claim is limited to the amount you paid us for ShopMail in the 12 months before the claim.
